Is Julian a lawyer?  From his post entitled: "The Bagpipe Didn't Say No" I would venture to guess he's not.  And if he is, I hope he isn't a litigator.   Precisely because this is a domestic matter the fact that District Court didn't deal with foreign surveillance is probative of the NSA program.   If the agents were purely foreign, or targets of surveillance I should say, this wouldn't have even made the NYT.  The fact is, the surveillance targeted American civilians, that makes the matter "domestic" for the purpose of the NYT article and the opponents of the program.
